FEES

The Service is billed in advance on a monthly or yearly basis. A valid credit card is required. There will be no refunds or credits for partial months of service or for periods in which your account remains open but you do not use the Service.

If You are domiciled in the United States of America, all fees and transactions will be denominated in United States dollars (USD). Unless otherwise stated, all fees and transactions will be denominated in Canadian Dollars (CAD). If You make a payment that is denominated in a currency other than Canadian dollars (CAD) or United States dollars (USD), please be aware that the funds will be converted into Canadian dollars (CAD) or United States dollars (USD) by Your financial institution and You may be charged a service fee for such conversion.

All prices and fees are non-refundable unless otherwise expressly noted, even if the Service is suspended, terminated, or transferred prior to the end of the term. Grit Creative Inc. expressly reserves the right to change or modify its prices and fees at any time, and such changes or modifications shall be posted online at this Site and effective immediately without need for further notice to you. If you have purchased or obtained Service for a period of months or years, changes or modifications in prices and fees shall be effective when the Service in question come up for renewal.

If for any reason Grit Creative Inc. is unable to charge your credit card for the full amount owed for the Service provided, or if Grit Creative Inc. receives notification of a chargeback, reversal, payment dispute, or is charged a penalty for any fee it previously charged to your credit card, you agree that Grit Creative Inc. may pursue all available lawful remedies in order to obtain payment, including but not limited to, suspension or immediate cancellation, without notice to you, of any domain names or Service registered or renewed on your behalf. You agree that if Your bank or credit card issuer rejects a charge your credit card, You may be liable to Grit Creative Inc. for interest, late fees and other charges. You may also be liable for any fees charged by the financial institution where You have Your bank account or, with respect to Your credit card, by the financial institution that issued You the bank card.

At our discretion, we may offer free or discounted pricing for use of the Service (a "Promotion"). Once the terms of any Promotion have expired, you agree that our normal billing rates shall apply. You agree to comply with any additional terms, restrictions or limitations we impose in connection with any Promotion. You may not sign-up for multiple accounts in order to receive additional benefits under any Promotion.

CANCELLATION POLICY

A 24 hour notice in advance of your scheduled billing date is required. All cancellations requests made within 24 hours of a scheduled billing date will be charged in full. Your account and all of its Content will be deleted immediately upon your cancellation of the Service. This information cannot be recovered once Your account is cancelled.

TERMINATION

Any unauthorized use of this Service or breach of these Terms of Use will automatically terminate the license granted by these Terms of Use, may violate applicable law including copyright laws, trademark laws (including trade dress), and communications regulations and statutes, and may in Grit Creative Inc.'s discretion result in termination of any of Grit Creative Inc.'s services to you.

Notwithstanding any of these Terms of Use, Grit Creative Inc. reserves the right, without notice and in its sole discretion, to terminate your license to use this Service, and to block or prevent future access to and use of this Service.

Complaints received by email or letter may be initially responded to by telephone.

We aim to resolve all complaints in a positive and expedient manner. Grit Creative Inc. will try to resolve your complaint at the point of first contact. However this might not always be possible.
Where the issues are complex, additional time may be required to allow Grit Creative Inc. to conduct proper enquiries. Where this is necessary, you will be kept informed of the progress of the investigation and the expected timeframe for completion.
Your Grit Creative Inc. customer service representative will always provide you with his or her name. You can ask for your complaint to be escalated to a more senior person if your complaint cannot be resolved. That person will review your complaint and discuss the matter with you.

COPYRIGHT AND INTELLECTUAL PROPERTY POLICY

Grit Creative Inc. respects the intellectual property of others, and we ask our users to do the same. When you use Grit Creative Inc. products or services you may access material that is available through other web sites and such material may be protected by copyright and intellectual property laws of Canada and/or other countries. The terms of use of those web sites, and not the Grit Creative Inc. Terms of Service, govern your use of that material.

It is Grit Creative Inc.'s policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who may infringe or repeatedly infringe the copyright or other intellectual property rights of Grit Creative Inc. and/or others.

If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide Grit Creative Inc. with the following information in English (your "Notice"):

a description of the copyrighted work or other intellectual property that you claim has been infringed;
a description of where the allegedly infringing material is located on the Grit Creative Inc. or service, with enough detail that we may find it on the site;
your address, telephone number, and email address;
a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law;
a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf; and
a physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest. This signature must be witnessed by another individual of legal age. Please clearly print the name of the witness on your notice.
